Most people want an uncontested divorce. Uncontested means that both parties agree to all of the terms of the divorce or that one spouse is willing to let the other spouse have whatever he or she wants. If a divorce is uncontested, you may not need the help of an attorney. Do-it-yourself uncontested divorce forms are available from numerous sources. The State of Oregon has a process called Summary Dissolution of Marriage for simple divorces; if you qualify under the Oregon statute, ORS 107.485, forms are available online through the State of Oregon Courts.

If you do not qualify for a Summary Dissolution, then your divorce will have legal complications needing the attention of an experienced divorce attorney. Even with an uncontested divorce, you should consult an attorney to help you with the required paperwork. Filling-in the blanks of a do-it-yourself divorce may not be as straightforward as it appears. Non-attorneys may offer to help fill in the blanks, but they are acting as a scrivener - filling-in the words you give them. Questions still remain as to “what to put in the blanks?” Some Oregon courthouses have domestic relations facilitators who may help you fill-in the paperwork. It’s worth a call to your local Circuit Court Domestic Relations Department.

Some of the advantages to consulting an attorney in an anticipated uncontested divorce are:

1. The attorney can come up with advice for dealing with problems that might turn an uncontested divorce into a contested divorce; and
