Small Estate Affidavit
Oregon recognizes that modest Estates can be managed and properly distributed without the additional costs and protective procedures of a full Probate process. If the Probate assets of the Estate are of limited value, a less costly, less time consuming, and a less complicated legal process called a Small Estate Affidavit is available. The current (2023) limitations in value are $200,000, or less, of real property and $75,000, or less, of personal property. A document called an affidavit is filed with the court by a “Claiming Successor,” and the Estate assets and debts are handled by the person filing the affidavit.
The Small Estate Affidavit only works if all interested parties in the Estate agree with this procedure. Any interested person of the Estate can supersede the Small Estate Affidavit by filing a Petition for “Full General Probate.”
