Owning real property in more than one State can upon the death of the owner result in multiple Probate proceedings - a separate Probate in each State where real property is located. The U.S.A. is a federation of 50 different States with 50 different sets of laws. Each State has its own laws and court system to regulate the vesting and transfer of real property within its boundaries. Many States take similar approaches in how they handle a decedent’s Estate, but each State has its own specific laws, statutes and rules for how an Estate must be administered. A judicial Probate proceeding outside the State of Oregon will not accomplish the transfer of title to real property located within the State of Oregon. If the title to Oregon real property needs to be transferred through a Probate process, then an Oregon Probate will have to be filed in the Oregon Courts.
