When selling real estate, there are many legal issues at various stages in the transaction where a real estate attorney can help explain and/or give assistance to a real estate seller.

One of the first questions for a seller is whether to list with a real estate broker or market the real estate as "For Sale by Owner." There are numerous pros and cons for hiring a real estate broker to market your real estate. Many knowledgeable real estate brokers will be able to explain, market, and facilitate the selling process. The real estate broker is the marketing expert, not your legal counselor. At many stages of the transaction, the financial and legal interests of the real estate broker will not coincide with your interest. If you decide to market your real estate as "For Sale by Owner," then the services of an attorney will becomes even more important.

Some of the stages in the marketing and selling process where an attorney can be very helpful to a seller are:

  1. Review and explanation of the Listing Agreement with the real estate broker;
  2.  Preparation, review, interpretation, and/or enforcement of an Earnest Money Agreement;
  3. Review, explanation, and removal of exceptions in the Preliminary Title Report;
  4. Review, preparation, and/or explanation of the escrow closing documents such as the Deed, Escrow Instructions, and Closing Statement.
