A simple Last Will and Testament is a very common cost effective Estate Plan for many people. Many attorneys will prepare a simple Will for $300 - $500. Preparation of a simple Will usually involves an initial consultation discussing some of the options and obtaining your instructions, and a second meeting for signing the Will.
Each attorney has a different definition for a simple Will, but a simple Will generally is two or three pages, identifies who are to be the beneficiaries of your Estate, names a Personal Representative (executor), identifies a Guardian for a minor child, and waives a bonding requirement. There will also be some legalese that attorneys always seem to include in their documents.
The wording and concepts are very generalized because, hopefully, the simple Last Will and Testament will cover most contingencies that may occur in life. A Last Will and Testament with many specific details may become obsolete as life changes - increases the chances of having to change the Last Will and Testament.
Do-it-yourself Last Will and Testament forms are available from numerous sources. Even with a simple Last Will and Testament, you should consult an attorney to prepare the Will. Filling in the blanks of a do-it-yourself Will may not be as straightforward as it appears. The wording may appear simple, but the concepts behind the words, and their impact, can be complex. The wrong combination of words can produce an unintended result.
A simple Last Will and Testament is not the right Plan if one of the Estate Plan’s primary goals is to avoid Probate. The Last Will and Testament does not avoid Probate, rather it is the document used for and in Probate.
