If you believe the Last Will and Testament submitted to Probate is not the Last Will and Testament of the decedent or for some reason is not a valid or effective Will of the decedent, there are numerous grounds for contesting the Will submitted to Probate. Some of the reasons for contesting the Will are:

    a. There is a later Last Will and Testament which supersedes the Will submitted to Probate;

    b. The Will submitted to Probate is a forgery;

    c. The decedent lacked legal capacity to prepare and execute the Will submitted to Probate;

    d. The decedent was subject to inappropriate “undue influence” when the Will was prepared and signed;

    e. The decedent made an agreement, promise or representation which should invalidate the Will submitted to Probate; and/or

    f. The Will was not signed and witnessed with the proper formalities and procedure.

There is a very short time limit to contest a Will - four months from receiving notice of the Probate proceedings or publication of the Probate proceedings. Delays in investigation and filing of the proper objections to the Will submitted to Probate will cut off your right to contest the Will.
